Terms of Service

1. Acceptance of Terms

By accessing or using Dúbal services, including any intake forms, creative briefings, avatar-based video generation, funnel builds, Facebook Ads management, course production, or related AI content creation, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services.

2. Services Provided

Dúbal offers done-for-you content creation and digital marketing services powered in part by AI technologies. This includes:

• AI Avatar Creation — a photorealistic digital avatar built from a 30-minute studio recording, including voice cloning and up to 5 distinct looks
• Video Scripting & Production — AI-assisted scripting, avatar video generation, and post-production delivery
• Multilingual Content — automatic translation and lip-sync of avatar content into 175+ languages
• Online Course Production — end-to-end production of course content delivered into your GoHighLevel community or Skool platform
• GHL Funnel Build — multi-step GoHighLevel sales funnels including landing pages, SMS and email automation sequences, and CRM setup
• Facebook Ads Management — paid social media advertising campaigns managed on behalf of the client on Meta platforms
• Bundle Packages — combinations of the above services as detailed on the pricing page

We do not offer direct access to a software platform. Our services are creative, consultative, and managed by our team.

3. Eligibility

You must be at least 18 years old and legally authorised to enter into binding agreements. If you are using Dúbal on behalf of a business, you affirm that you have authority to bind that entity to these Terms.

4. User Content & Ownership

You retain ownership of any content you provide to Dúbal ("User Content"), including scripts, visuals, and likeness. You grant Dúbal and its partners a limited, royalty-free licence to use, modify, reproduce, and process this content strictly for the purpose of delivering the agreed-upon services.

Use in Dúbal Marketing Materials

Unless explicitly requested otherwise in writing, you grant Dúbal permission to feature final deliverables (such as avatar videos, branded content, course previews, and testimonials) in Dúbal's own marketing, portfolio, pitch decks, or case studies. We will never use sensitive or confidential material (such as unreleased products, private scripts, or data) without your prior written approval.

5. Avatar and Likeness Processing (HeyGen Disclosure)

By submitting video, voice, or likeness data to Dúbal, you authorise us to process that data via third-party providers such as HeyGen. This may involve:

• Generating a synthetic avatar using your biometric likeness
• Temporary storage of facial and voice data
• Optional AI model training (you may opt out at any time by emailing [email protected] with the subject line "Model Training Opt-Out")

6. Prohibited Uses

You may not use Dúbal services to:

• Generate content without the consent of depicted individuals
• Violate privacy or intellectual property rights
• Distribute misleading, violent, or fraudulent content
• Represent AI-generated content as fully human-made without appropriate disclosure
• Circumvent our creative process to resell or replicate outputs without authorisation

7. Payment & Refunds

All services are pre-paid unless otherwise agreed in writing. Due to the bespoke and done-for-you nature of our services, refunds are not guaranteed and will be considered only in cases of non-delivery or documented service error. A refund request must be submitted in writing to [email protected] within 48 hours of purchase and before any work has commenced. Stripe is used as our payment processor.

8. Termination

We may suspend or terminate your engagement at any time if you violate these Terms or use our services in bad faith. You may also cancel your engagement with Dúbal at any time by contacting [email protected]. Termination does not affect your licence to already-delivered creative assets.

9. Limitation of Liability

Dúbal's total liability to you shall not exceed the amount paid for services rendered in the three months prior to the claim. We are not liable for any indirect, consequential, or incidental damages, including misuse of or third-party reliance on generated content. We do not guarantee specific business outcomes, advertising performance, or return on investment from any service we provide.

10. Confidentiality

Any materials shared between you and Dúbal that are not public (such as brand strategy, pre-launch materials, or unreleased content) will be treated as confidential and not disclosed to any third party without your prior written permission.

11. Dispute Resolution

These Terms are governed by the laws of Ireland and, where applicable, the laws of the State of California. Any disputes shall first be attempted to be resolved informally by contacting [email protected]. If unresolved within 30 days, disputes shall be settled by binding arbitration. You waive class actions and agree to individual dispute resolution.

12. Revisions to These Terms

We may update these Terms from time to time. The latest version will always be available at dubal.ai/terms. Continued use of our services after changes implies acceptance of the updated Terms.
